RSJ members sign this waiver digitally — your signature is timestamped, stored securely on your account, and legally binding under the Electronic Communications Act 2000. This page is a reference overview.
UK Law Notice (Unfair Contract Terms Act 1977, s.2): RSJ Surf Academy cannot and does not exclude or restrict its liability for death or personal injury caused by its own negligence or that of its employees, agents, or contractors. This document constitutes an informed acknowledgment of the inherent risks of surfing — not a waiver of any right to bring a claim in negligence. Retained in accordance with the Limitation Act 1980 and RSJ's data retention policy.
Section 1 — About This Document
This Adult Activity Risk Acknowledgment and Waiver ("Waiver") must be completed by every adult participant before their first RSJ Surf Academy coaching session, programme, camp, or experience. "Adult" means any person aged 18 or over at the time of signing.
This Waiver is completed once and is stored on your RSJ account for as long as you remain active with RSJ, and for the period required by law thereafter. You will be notified if a material change to RSJ's services or applicable law requires you to re-sign.
By signing this Waiver you confirm that you are 18 or over, that you are entering this agreement voluntarily and with full understanding of its contents, and that all information you provide is accurate and complete.
Section 2 — Personal & Contact Information
The digital waiver form in your portal will collect the following information. Providing accurate details is required before participation.
All personal information is processed in accordance with UK GDPR and RSJ's Privacy Policy at rsjsurfacademy.com/privacy.
Section 3 — Medical Declaration
Your safety is our priority. Please disclose any conditions relevant to physical activity in the ocean. This information is treated as special category health data under UK GDPR and is accessed only by RSJ's coaching team on a need-to-know basis.
The waiver form asks whether any of the following apply to you (currently or in the past 12 months):
- —Asthma or other respiratory condition (including exercise-induced)
- —Heart condition, cardiac history, or irregular heartbeat
- —Epilepsy or seizure disorder
- —Diabetes (Type 1 or Type 2)
- —Ear conditions, perforated eardrum, or grommets
- —History of concussion, head injury, or spinal problems
- —Anxiety, panic attacks, or conditions that may be triggered by open water
- —Joint injury — knee, shoulder, or ankle (current or recurring)
- —Current pregnancy
- —Medication that may affect reaction time, balance, or cognition
- —Any other condition that may affect ability to surf safely
If you tick any condition, you'll be asked to provide details for the coaching team. Incomplete disclosure of relevant medical information may affect our ability to keep you safe.
Section 4 — Swimming & Ocean Ability
The waiver asks you to self-assess your swimming and ocean experience. Coaches use this to ensure activities are appropriate for your ability. Being a weak or non-swimmer does not automatically preclude participation, but will affect which sessions RSJ can offer you.
You'll select from the following options:
- —Strong swimmer — 200m+ unaided in open water
- —Competent swimmer — comfortable in pools, limited ocean experience
- —Weak or non-swimmer — will inform coach before every session
- —Experienced ocean surfer — comfortable in 4ft+ surf
- —Moderate — some ocean experience, usually surf up to 3ft
- —Novice — limited or no prior ocean experience
Section 5 — Risk Acknowledgment
UK Law Notice: This section asks you to acknowledge the inherent risks of surfing. It does not — and legally cannot under the Unfair Contract Terms Act 1977 — limit or exclude RSJ's liability for harm caused by RSJ's negligence. If RSJ or its coaches act negligently and you are harmed as a result, you retain all legal rights to bring a claim.
By signing the waiver you acknowledge that surfing and all RSJ coaching activities involve inherent and unavoidable risks, including without limitation:
- —Drowning or submersion in ocean water, including where a surfboard leash, wetsuit, or other equipment may impair movement or surfacing
- —Collision with your own surfboard, the surfboards of other surfers, the coaching team, or other water users
- —Impact with the seabed, rocks, reef, or submerged or surface hazards
- —Strong rip currents, sudden swell sets, tidal shifts, and unpredictable ocean conditions
- —Marine hazards including jellyfish stings, weever fish, and rare encounters with larger marine life
- —Cuts, lacerations, and abrasions from fins, surfboard rails, rocks, or reef
- —Musculoskeletal injuries including sprains, strains, torn ligaments, and fractures
- —Spinal or neck injury resulting from wipeouts, wave impact, or contact with the sea bed
- —Concussion or traumatic brain injury from impact with a surfboard or the ocean floor
- —Hypothermia, sunburn, dehydration, and other environmental exposure injuries
- —Exhaustion and impaired capacity in the ocean as a result of extended physical effort
- —Psychological distress, including anxiety or panic response in challenging ocean conditions
RSJ takes all reasonable steps to minimise these risks — including maintaining appropriate coach-to-participant ratios, conducting pre-session condition assessments, providing safety briefings, and ensuring coaches hold current first aid qualifications and water safety training.
Section 6 — Consent to Coaching Activities
Signing the waiver confirms your consent to the following:
Participating in RSJ coached ocean surf sessions at beaches, surf breaks, and wave pool facilities.
Participating in land-based activities as part of RSJ's coaching — including strength and conditioning, trampoline, surf skate, and theory sessions.
RSJ coaches providing appropriate first aid for minor injuries; emergency services being contacted immediately for serious emergencies.
RSJ coaches making final decisions on session safety, including the right to exclude you from a session or part of a session where they deem it unsafe.
Appropriate physical assistance from coaches as part of surf instruction — including positioning, in-water support, and technique demonstration.
Section 7 — Equipment and Personal Insurance
RSJ Equipment
Where RSJ provides surfboards, wetsuits, leashes, or other equipment, you agree to use it responsibly and to notify the coaching team immediately of any damage or fault. You may be liable for the cost of damage caused by negligence or deliberate misuse.
Personal Equipment
Where you use your own equipment, you confirm it is appropriate for the conditions and in good repair. RSJ accepts no liability for damage to personal equipment during sessions.
Personal Insurance
RSJ holds appropriate public liability insurance for its coaching operations. We strongly recommend that all participants hold personal accident insurance appropriate for water sports. RSJ does not provide personal accident or medical insurance.
Section 8 — Video, Photography, and Media Consent
8A — Coaching Video Analysis
RSJ records video footage of coaching sessions for biomechanical analysis, performance feedback, and progression tracking. This footage is held securely in your RSJ member portal (Kaizen Lab) and is accessible only to you and named RSJ coaches. It is not shared publicly, used for marketing, or disclosed to third parties. Consent to coaching video is required for full participation.
8B — Promotional Photography and Video (Optional)
RSJ may wish to use photographs or video for promotional purposes — website, social media, and marketing content. This is entirely optional. You'll be asked to indicate your preference in the digital form. Promotional consent may be withdrawn at any time by contacting surf@rsjsurfacademy.com.
Section 9 — Health & Biometric Data (RSJ Watch App & Mobile App)
The RSJ Apple Watch App and Mobile App collect health and biometric data — including heart rate, GPS tracking, wave count, speed metrics, distance paddled, and calorie estimates. This is special category health data under UK GDPR Article 9(1) and requires explicit consent before collection.
Health data is used solely to analyse your surfing performance and support your coaching development. It is never sold, shared commercially, or used for any purpose outside your coaching relationship with RSJ. You may withdraw consent at any time via the portal, which disables data collection immediately.
The RSJ Watch and Mobile apps are available from Remote membership upward (with limited features). The health and biometric tracking covered by this consent — such as heart rate and calorie estimates — unlocks on the Performance and Elite tiers. Declining this consent does not affect access to any other RSJ service.
Section 10 — Data Protection
RSJ processes your personal data in accordance with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy is available at rsjsurfacademy.com/privacy. This Waiver and the data it contains will be retained for 7 years from the date of your last RSJ activity, in accordance with the Limitation Act 1980 and RSJ's data retention policy.
Health and medical information provided in the medical declaration is processed as special category data under UK GDPR, for the purpose of ensuring your safe participation in RSJ's activities. It is never used for any commercial purpose.
Section 11 — What You're Confirming by Signing
By signing the waiver (digitally via the portal, or in print), you confirm that:
- —You are 18 years of age or older.
- —All information provided is accurate, complete, and up to date.
- —You have read and understood this waiver in full.
- —You understand this document acknowledges inherent risks of surfing, but does not waive any right to bring a claim for injury caused by RSJ's negligence.
- —You accept RSJ Surf Academy's Terms and Conditions, available at rsjsurfacademy.com/terms.
- —You will inform RSJ of any material change to the information provided before your next session.
- —You have had the opportunity to read this document carefully and ask questions before signing.
- —Your typed name in the digital portal, or handwritten signature on a printed copy, constitutes a legally binding signature under the Electronic Communications Act 2000 (UK).
Paper copies may be handed to your RSJ coach or returned to surf@rsjsurfacademy.com before your first session. A countersigned copy will be returned to you for your records.
